Introduction of Baia' ta'ati and the role of social norms and it modern applicability

Abstract

Different types of transactions are used in our daily life. Some time things are bought on cash, and some time on   credit(قرض),

some times advance payment are made and also some one gives order to get something  not yet made. Similarly partnership are made with others on equal shares and sometime on   give money and the other man gives services.  In this paper Baie Moa, ata(بیع معاطاۃ)will be discussed.

It is a type of business in which a person takes a commodity of his need, makes payment without saying   words of offer and accept

(ایجاب اور قبول ) which is must for transactions (بیع)to be fulfilled. Authenticity or lawfulness of   Baie Moa,ata(بیع معاطاۃ)  will be discussed in the light of Quran, sunnah and  Ijmaa(اجماع).In this regard the views of different sects(مسالک) of fiqah will also be highlited
