A Juridical Analysis of Family Laws in Surah Al-Baqarah According to Imam Al-Baghawi DOI:https://doi.org/10.5281/zenodo.16418176
Abstract
The Holy Quran has been declared as "Muhaymin" (Guardian and Protector) over the previous divine scriptures, serving as a source of guidance for all humanity until the Day of Judgment. It provides direction in every aspect of life, particularly in familial and societal matters. Since the family is the foundation of Islamic society, the Quran has explained important marital rulings—such as marriage, divorce, Ila (vow of continence), Khula (divorce initiated by the wife), and breastfeeding—with great clarity.Commentators, especially Imam Al-Baghawi (may Allah have mercy on him), in his exegesis of Surah Al-Baqarah, elaborated on all these familial issues in light of the Quran, Hadith, the sayings of the Companions, the Tabi’in (successors), and the opinions of the jurists. Since Imam Al-Baghawi was affiliated with the Shafi’i school of jurisprudence, he represents Imam Shafi’i’s juristic stance on these matters. He also authored a renowned book on Shafi’i jurisprudence titled "At-Tahdhib", which gained popularity in scholarly circles. Moreover, the verses of Surah Al-Baqarah do not only address familial issues but also mention other significant events, such as the accounts of the Children of Israel and the conspiracies of the Jews, which serve as reminders of Allah’s blessings and admonitions for mankind.
